Conditions of Sale

Each lot is this auction are subject to the terms set out below, as changed or supplemented by provisions a) written in the catalogue, b) supplemented by other materials provided by the Seller and c) as stated by the auctioneer. No other communications by any employee of the Seller is intended to be binding and such communications are made for informational purposes only.

ALL SALES ARE FINAL. No cancellations, returns, exchanges, credits or refunds. Every lot is sold “as is” with all faults and defects and without recourse against the Seller for any reason whatsoever. All lots will be sold to the highest bidder as determined in the sole and exclusive judgment of the auctioneer. The auctioneer will also have the sole and exclusive authority to resolve any disputes between bidders and to regulate the bid increments.

NO STATEMENT WHETHER WRITTEN OR ORAL SHALL BE DEEMED A WARRANTY. No statement whether written or oral shall be deemed a warranty or representation of fact, correctness of description, physical condition, size, quality, age, genuineness, attribution of authorship or authenticity of any item or items sold at the auction or on the internet. Moreover, any description is rendered as an opinion, including, but not limited to a specialist’s opinion of authenticity, including the enhancement or treatment of gemstones, the country of origin, the authorship or manufacturing period or the authenticity of any marks or signatures.

Prospective bidders should inspect the property before bidding to determine its condition, size and whether or not the item has been damaged, repaired or restored. By bidding at the auction Purchaser agrees to be bound by the terms and bidding price, whether bidding in person, through a representative, by phone, by internet or other absentee bid.

BUYER’S PREMIUM. A buyer’s premium of 23% of the successful bidding price shall be added thereto and is payable by the Purchaser as part of the purchase price.

All purchases must be paid at the time of the sale by cash, check or charge and removed by Purchaser at Purchaser’s own expense. In addition, Purchaser will be required by law to pay the prevailing tax rate. A current, valid resale certificate must be presented at the time of sale in order for dealers to avoid sales tax on your invoice.

The Purchaser of any auctioned item will pay for the purchased property immediately after the sale and remove it from the premises within fourteen (14) days of the sale. Any item(s) that are left for more than fourteen (14) days will be charged a storage fee to be determined in the sole discretion of the Seller. Normal pick-up hours are Monday-Friday, 9:00 a.m.-5:00 p.m., excluding holidays.

APPRAISALS. Appraisal services are available upon request. Please ask for a quote as the fees vary according to the item(s) and/or circumstances.
